Reviewed 15 October 2026. A YMS or India YPS holder may be able to switch to Skilled Worker from inside the UK, but the new route’s requirements still apply. A licensed employer, eligible role, appropriate salary, sponsorship and other conditions must be assessed; working for an employer does not itself create sponsorship.

Open work permission can help build UK experience, but it does not convert automatically into a sponsored visa. Start the later-route conversation early enough to assess the employer, job and application timing. The useful plan is a sequence of evidence-based decisions, with a lawful alternative if sponsorship does not become available.

Separate employer, role and applicant checks

An employer’s licence is only one part of the picture. Check that the actual job is eligible, the salary and other role conditions fit, and the employer is willing and able to sponsor that position. The applicant must also meet the personal requirements, including the applicable English standard and switching conditions. Avoid quoting a single salary number as if it answers every occupation and transitional case.

Run an honest employer conversation

Ask about the company’s sponsorship process, who owns the decision and whether the specific role is being considered. Do not describe a general statement that “we sponsor people” as a confirmed offer. Record stages such as enquiry, role review, internal approval, certificate of sponsorship and application. Keep confidential employer documents private and avoid promises to colleagues based on incomplete discussions.

If the employer does not hold a licence, licensing is a separate employer project with its own requirements and timing. It should not be assumed to complete before your expiry. Do not pay for a fabricated role or a guaranteed sponsorship certificate. A genuine route depends on the actual business and employment circumstances.

Protect timing and the alternative

Record the current permission expiry and work backwards through employer decisions, evidence and application steps. Check current switching rules and travel implications before acting. Time on YMS is not automatically added to the Skilled Worker five-year settlement period; a different long-residence question, where relevant, needs its own assessment. Keep a departure or alternative-route plan that does not depend on an unconfirmed sponsor.

Stage Evidence of progress Still not established
Employer enquiry Named decision maker Sponsorship for your role
Role review Occupation and salary assessment Applicant eligibility
Internal approval Genuine employer process Visa grant
CoS / application Actual sponsorship and submission Outcome until decided
Next permission Decision and status Future settlement automatically

Use milestone evidence for the sponsorship conversation

Record each stage in language that matches the evidence. “HR will discuss the role” is different from “the business has approved sponsorship”; neither is the same as a certificate of sponsorship or a visa grant. A clear log prevents a supportive conversation being repeated later as a confirmed commitment. Keep dates and the named decision maker, and respect confidential employer information.

For the role assessment, use actual duties, occupation treatment, salary and relevant personal circumstances. Do not fit a job into a favourable label simply because it makes the route appear easier. If the employer needs licensing or has compliance questions, that is a real dependency with its own owner and timing. The applicant’s expiry cannot by itself make the employer process faster or the role eligible.

Create an early internal decision point at which you review whether the dependencies are realistic. If a key stage remains unowned, investigate another lawful option or departure while there is time. Keep any settlement or long-residence question separate from the immediate switch and verify it under the applicable rules. A transition planner is successful when it produces a credible next decision based on facts, not when it keeps an attractive but unconfirmed sponsorship story alive until permission runs out.

Keep the current route’s conditions active while planning a switch. A future sponsored role or application discussion does not itself replace the permission you hold today. Check actual work and travel implications before changing activities.

A practical example

A holder works for a company that appears on the sponsor register. Rather than assuming that guarantees a switch, she asks whether her actual role can be sponsored and records the employer’s review steps. The plan leaves enough time for another outcome. A company licence is treated as a starting fact, not a personal visa promise.

Put the plan into practice

Use the accompanying resource to turn the explanation into a file you can actually review. Work through these actions in order; where a point is uncertain, record the uncertainty rather than changing the facts to fit a preferred answer.

  1. Record current expiry and the minimum planning tasks before it.
  2. Check employer, role and applicant conditions separately using current guidance.
  3. Keep employer discussions factual and distinguish interest from approval.
  4. Prepare a lawful alternative if the role or timing does not work.

Questions to resolve before you act

Is the employer sponsoring this actual role? Have salary and occupation conditions been assessed correctly? Are you relying on a certificate that does not yet exist? Does the timeline include an alternative if the process stops?
